America, the Torture Nation

"Ever since we were attacked on 9/11, there has been an ongoing debate over how to fight the war on terror. There are some folks, like me, who believe we must use harsh measures to defeat the Jihadists who would slaughter us all if they could. There are others who say we must obey the Geneva Convention even though we are fighting an enemy that does not fall under that treaty...

"Enter a report by Democrats on the Senate Intelligence Committee. It says that the CIA tortured captured al Qaeda suspects and lied about it to Congress...All of the Republicans on the committee refused to endorse the report, which by the way cost 40 million dollars to produce...

"Some say the report should never have been released because it puts U.S. operatives around the world in danger. I don't dispute that, but in an open society, if the CIA or any other federal agency breaks the law, we the people should know it. That being said, Talking Points does believe the report is a partisan play that will not solve anything."

The Senator relayed that Republicans were "aghast" by the report because the people who compiled it didn't view any witnesses. He said the concerns were that it was biased and contained classified information that would, if released, have serious consequences. Republicans apparently pulled out of contributing the report when the Attorney General brought criminal charges into the coerced intelligence cases because they thought it might taint witness reports.

The Factor asked if members of the Senate Intelligence Committee thought the CIA misled them during testimony. The Senator stressed his committee is part of an oversight process and this issue is being dealt with, but dodged the question to focus on the larger issue.
Torture Report Released

A 2011 Fox News poll asked "Do you support or oppose allowing the CIA to use enhanced interrogation techniques, such as waterboarding, to try to obtain information from terrorist suspects?" 63% support, 30% oppose, and 7% don't know.

The Factor maintained the report should have been released because when there are accusations a federal agency broke the law, we need the information. Monica disagreed, citing this is a matter of national security. "Some secrets should be held very close to the vest." The Factor recognized her point was valid, but told Monica, as a journalist, he wants the sunshine.

Ms. Konst defended the report, saying it's based on evidence. She ceded it would have been better if it was a bipartisan report, but pointed out we have a Congress that isn't really speaking to each other right now. She argued with the Factor about how many members of the CIA brass were interviewed for the report.
NPR's Attack on Jesus

An NPR comedy show mocked Jesus this weekend after the Catholic Diocese of Brooklyn put out an ad of a young woman taking a selfie with the son of God behind her. Is this another example of discrimination against Christian?

The Factor stated the Diocese put out this ad to get people to come back to church during the Christmas season. The Pastor said this demonstrates the hypocrisy of the liberal media when it comes to Christianity, and guaranteed if the host had ridiculed Mohammed, he would have been fired overnight. He expressed outrage that the taxpayers are subsidizing NPR to the tune of $40 million a year to support this kind of junk.

The Factor concluded he wants to be charitable because it's the Christmas season and give the NPR host the benefit of the doubt that he wasn't making a salacious reference about Jesus.
Evaluating the Demonstrators

Our pal Stossel went out on the streets of New York City to ask folks how they feel about the protests around the city over police brutality. Most citizens were fine with the protesters, and one African-American man even supported the looting.

The Factor ran down some statistics: there are 43 million African-American in the United States. 123 have been killed by police this year, even though black Americans commit more than 4,000 murders a year.

Stossel defended the protesters and the cops simultaneously, saying there 800,000 cops in NYC and some of them will be sadists or jerks. But he insisted when they abuse people, it won't be white men like him and the Factor. The Factor countered that while that may be true, you don't shut down a whole society because of isolated incidents. He also doubted the protesters understand the big picture.
Congressional Testimony

Dr. Jonathan Gruber, an architect of Obama-care, testified before Congress today and apologized for misleading the American public about the health care law. But President Obama is still insisting premiums will go down under his plan.

Wiehl confirmed premiums are going up about 5% for regular folks, while deductibles are going up 300+% under Obama-care.

The Factor wondered whether fraud in the inducement would be appropriate here since Dr. Gruber is admitting Americans were deceived about how their health care costs would be impacted under Obama-care. Guilfoyle believed a case against the President or Dr. Gruber would not be successful, but the information will have a human interest impact when the Supreme Court considers Obama-care.

On Ferguson, Missouri, the transcript of one of the witnesses favorable to Michael Brown's case was not released with the rest of witness testimony. The Factor thought this information should be included in the exposition. The legal ladies explained Attorney General Eric Holder decided to hold it back because it was pertinent to an ongoing federal investigation. The Factor assessed the rationale - and decided it made sense.
Christmas at Costco

We sent Watters to Costco to see how Americans handle their Christmas shopping, and proceeded to load many copies of "Killing Patton" into people's shopping carts.

Jesse said the most popular buys of the season are Elf on the Shelf and Frozen, which he apparently loves because he's watched it 1,000 times.
